These Terms of Use govern your access to tex-ra.com, operated by Texas Industrial Robotics and Automation LLC. By using the site you agree to them. If you do not agree, please do not use the site.
1. The site
This website presents information about our engineering, robotics, artificial-intelligence and permitting services, including industrial automation for manufacturing plants. It is provided for general information and for making contact with us.
2. No engineering advice and no professional relationship
Nothing on this site is engineering advice, a professional opinion, a certification, or a recommendation for any particular plant, process or installation. Content on this site does not create an engineer–client relationship. Engineering services are provided only under a written agreement, for a defined scope, and where required are performed under the responsible charge of a licensed professional engineer in the applicable jurisdiction.
3. Performance figures and project references
Any output, labour, payback, throughput or schedule figures shown on this site are indicative ranges drawn from prior projects and industry experience. They are not a warranty, guarantee or representation of results for your facility. Actual results depend on your equipment, product, layout, staffing and operating conditions, and can only be established by a site-specific assessment.
Project references and case material are described for illustration. Some are anonymised at the client's request. Where a project reached engineering or design stage only, that is stated.
Permitting timelines depend on the authority having jurisdiction and are outside our control.
4. Intellectual property
The site, its text, layout, drawings, renderings, graphics, logos and the TEX-RA name are owned by us or used with permission, and are protected by United States and international intellectual property law. You may view and print pages for your own business evaluation. You may not copy, republish, sell or use our content or marks commercially without our prior written consent.
5. Acceptable use
- Do not use the site unlawfully or to infringe the rights of others.
- Do not attempt to gain unauthorised access to the site or its infrastructure.
- Do not use the contact form to send unsolicited commercial messages, malware or harmful code.
- Do not scrape, mirror or systematically extract the site's content.
6. Submissions
Information you send through the contact form is handled in line with our Privacy Policy. The web form is not a secure channel: please do not submit confidential drawings, specifications, pricing or trade secrets through it. If we need confidential material, we will agree a suitable channel and, where appropriate, a non-disclosure agreement.
7. Third-party links
The site may link to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.
8. Disclaimer of warranties
The site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. 9. Limitation of liability
To the fullest extent permitted by law, Texas Industrial Robotics and Automation LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising out of or relating to your use of the site, whether based in contract, tort or any other theory. Our total aggregate liability arising out of or relating to the site will not exceed one hundred United States dollars (US$100).
Nothing in these terms limits liability that cannot lawfully be limited.
10. Indemnification
You agree to indemnify and hold harmless Texas Industrial Robotics and Automation LLC from any claim, loss, liability and expense, including reasonable attorneys' fees, arising from your misuse of the site or breach of these terms.
11. Governing law and venue
These terms and any dispute arising out of or relating to them or to the site are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
12. Changes
We may revise these terms at any time by posting an updated version on this page. Continued use of the site after a change means you accept the revised terms.
